INTRODUCTION

According to Section 126 of Indian Contract Act 1872 the ‘Contract of guarantee’ is a contract to perform the promise or discharge the liability of a third person in case of his default.

There are three parties involved in this transaction-

Surety- The person who gives the guarantee.
Principal debtor- The person in respect of whose default the guarantee is given. (The third person)
Creditor- The person to whom the guarantee is given.

Guarantee may be either oral or written.

Example of guarantee-

A enters into the contract of guarantee with B that if she delivers the goods to C within the next 5 days, A himself will pay for this. Next B delivers the goods to C in 5 days and then A pays for the goods.

This was a contract of guarantee and the consideration was the promise to pay for the goods when the order is complete. (Section 127 of Indian contract act, 1872)

CONTINUING GUARANTEE

According to section 129 of the Indian Contract Act, ‘Continuing guarantee’ is the guarantee which extends to a series of transactions.

The Valentins, a Black couple of Haitian origin who have lived in the town of Natick, Massachusetts for about 30 years and work as condominium developers, submitted an application for a permit to develop a condominium project and establish affordable housing in their predominately white neighborhood. Following a denial, they brough this action was brought under the Fair Housing Act (FHA) and Massachusetts Civil Rights Act (MCRA) against the town, the town planning board, the town historical commission and the chair of the town historical commission for the violation of their due process and equal protection rights. They allege that the denial of their application was motivated by discrimination on the basis of color, race and national origin. The Complaint also alleged that the Board had not denied a permit for any condominium project for over a decade. Noteably, each of these projects had been sponsored by white applicants. In response, the Town moved to dismiss the action for failure to state a claim.

Former President Donald Trump’s midterm failures may have eroded the Republican support he was counting on to avoid a criminal conviction, according to one attorney.

Trump has long been reported to be planning an early 2024 presidential campaign announcement as a way to stave off potential prosecution from the numerous investigations mounting against him. His hope had purportedly been to ride a wave of midterm GOP success into the announcement, but with Democrats posting historically strong results over the last week, Trump’s future as a Republican figurehead and his 2024 candidacy have been cast into doubt.

In a report published on Sunday, The Daily Beast spoke with numerous current and former attorneys and general legal experts about the situation facing Trump. Most said that his plan to avoid criminal prosecution by running for reelection would do him no good, as the various investigations arrayed against him are too far along. Reports previously indicated that Attorney General Merrick Garland was looking to indict Trump after the midterms, to avoid swaying voter opinions, but before the start of the 2024 election cycle.

The shock over FTX’s sudden collapse is turning to anger as it becomes clear that CEO Sam Bankman-Fried used customer funds from the exchange to plug losses in his failing crypto empire. The question now is what the consequences will be for the one-time icon known to everyone as SBF.

While there will be civil lawsuits as customers and investors try to recover what’s left of FTX’s assets, the Justice Department is also reported to be investigating, raising questions of whether the agency will file criminal charges, and whether SBF could see the inside of a prison cells.

Even if the facts seem may seem damning on the surface, lawyers contacted by Fortune cited two potential obstacles to any criminal conviction—though ones prosecutors could likely overcome.

The first is jurisdiction. Since FTX is an offshore business with headquarters in the Bahamas, and did not cater to Americans, defense lawyers could argue the actions of its executives are beyond the reach of US law enforcement.

The Justice Department, however, is good at finding a “nexus” linking overseas defendants to American shores, according to Randall Eliason, a former prosecutor who now teaches law at George Washington University. Two other lawyers who spoke
